After the order, by taking delivery of consignments the customer indicates his acceptance of our terms of delivery and payment.
The publisher reserveS the right to deliver against payment in advance. The delivery dates of new publications and new editions cannot in all instances be given definitely.
The buyer undertakes to adhere to all prices by the publisher for products of the Publishing House. Postage and handling fees will be charged in addition. Should the Publisher have announced price alterations before receipt of an order the new prices shall apply ; without retroactive effects.
Consignments which are lost or damaged during transport will not replaced by Sides. Thus, in order to safeguard his interest, the buyer or consignee must report any lost loss or damage to the postal authorities or other carriers within the period stipulated by them.
NOTICE OF DEFECTS
All products are controled and are considered without any defects. Unless the consignee informs Sides of the discrepancy or given notice of a defect within a period of less than one week of receipt of the consignment. Any complaint must state date and type of consignment, contents and number of invoice.
EXCLUSION OF LIABILITIES
Sides do not assume any liability for any errors caused by gross negligence, which lead to losses in turnover or consequential losses.
Payment are due to receipt of goods, provided that nothing to the contrary has been agreed. Payment in foreign currencies will be accepted at the current rate of exchange. No cash discount will be given. Payment by check is recommended. Payment by bill of exchange will be accepted if the total amount on the invoice is more than 150€.
DEFAULT IN PAYMENT
If the customer defaults on payment, all oustanding accounts become due and payable forthwith: P.C.A. may charge interest on arrears as the usual banking rate.
RESERVATION OF PROPERTY RIGHTS
The items supplied by us remain our property until they have been paid for completely.
PLACE OF JURIDICTION
The place of juridiction is the site of the head office of Sides, as it is the Commercial Court of Creteil.
